Performance Programme Terms of Service

These terms govern the relationship between you and the service provider when you subscribe to any of the Performance packages. Enrolling means you accept them in full.

1. Parties and definitions

Service provider: Sports Academy for Arab, commercial registration 123059-2, Kingdom of Bahrain, represented by Mohamed Saad, sports scientist, through the Arabolics platform at arabolics.com.

Athlete: the natural person who completed enrollment and paid in their own name.

Protocol: the delivered package, comprising the laboratory interpretation report, nutrition plan, supplement plan, and follow-up schedule.

Working days: Sunday to Thursday. Response times are counted within these days only.

Term: three months (12 weeks), starting as set out in clause 4.

2. Scope of service

The service is remote nutritional, physiological and laboratory supervision, covering, depending on the package: building the nutrition plan, the supplement plan, interpreting laboratory panels, monitoring biomarkers, and competition preparation.

Enrollment is available strictly to those meeting all of the following:

Effect of failing an eligibility condition

If it becomes clear after enrollment that the athlete does not meet these conditions, the subscription is terminated and refunded in full without deduction, unless the protocol has already been delivered. If it was delivered on the basis of inaccurate information provided by the athlete, the subscription is terminated without refund.

4. Term and when it starts

Each package runs for twelve weeks, starting on the earlier of the following:

If ninety days pass from the payment date with no contact from the athlete, despite two documented written reminders, the subscription is treated as expired without refund.

5. Service levels

The following is the binding definition of what appears on the programme page.

Definition of an urgent case

Strictly: less than 72 hours before a competition, acute injury, an emergency health symptom, or an urgent query about a possibly prohibited substance. Anything else is treated as ordinary messaging. Direct access around the clock means the channel is open, not that every message is answered instantly.

Video calls

Plan adjustment

Professional: review and adjustment every two weeks. Elite: review and adjustment weekly. In both cases this requires the athlete to have submitted their data for the period under review. Delay caused by unsubmitted data is not treated as a failure by the service provider.

Laboratory cycle

Competitor every 24 weeks · Professional every 16 weeks · Elite every 12 weeks. This means specifying and interpreting the tests, not the cost of running them.

6. Athlete obligations

Data interruption

The service is managed by data. If the athlete fails to submit three consecutive follow-up reports, after two written reminders, the service provider may terminate the subscription without refund.

7. Laboratory testing

Testing is a prerequisite for starting the protocol, and is carried out at an accredited laboratory chosen by the athlete at their own cost. The service provider specifies the panel and interprets the results, and bears neither the cost nor responsibility for the laboratory’s accuracy.

No protocol is delivered before the required results are received.

9. Medical boundaries

This is a sports nutrition, sports science and laboratory interpretation service. It is not a medical service and is not a substitute for the athlete’s treating physician. No medical condition is diagnosed here, no drug treatment is prescribed, and no existing prescription is altered.

The athlete must consult their physician before any material change to their nutrition if they have a medical condition or take prescribed medication. Any clinical case is referred to the appropriate specialist.

10. Ownership of content

All plans, reports and files delivered remain the property of the service provider. The athlete is granted a personal, non-transferable licence to use them for themselves only, during the subscription term and afterwards.

Copying, sharing, selling, publishing, or using them to coach others is prohibited. Files are delivered marked with the athlete’s name and subscription number. Breach of this clause terminates the subscription immediately without refund, with the right to claim damages reserved.

11. Confidentiality and data

The athlete’s health and athletic data are treated in strict confidence and are not shared with any party without their written consent, except as necessary to operate the service as set out in the Privacy Policy, which forms an integral part of these terms.

12. Cancellation and refunds

Refund requests are processed within fourteen working days through the original payment method. The service provider does not bear transfer fees or exchange rate differences.

13. Suspension and extension

The service provider may suspend the service for up to fourteen days within a single term for an emergency or travel, with the subscription extended by the same period.

The athlete may request one suspension of up to four weeks in cases of documented injury or force majeure, with the term extended accordingly.

14. Renewal

Renewal is not automatic and no amount is charged without an explicit request from the athlete. A term review is held in week eleven, on the basis of which the renewal decision is taken.

15. Limitation of liability

The service provider does not guarantee any specific sporting result, time or ranking, because outcomes depend on factors outside their control including training, genetics, adherence, injuries and technical staff decisions. What is undertaken is the method, the measurement, and the follow-up at the agreed service level.

The service provider’s liability is in all cases limited to the amount paid for the term in dispute, and they are not liable for any indirect or consequential loss.

16. Force majeure

Neither party is liable for delay or failure caused by circumstances beyond their reasonable control, including communications failures, disasters, government measures, and serious illness. Affected periods are extended accordingly.

17. Amendments to these terms

These terms may be updated, and each version carries a number and date. Amendments do not apply retroactively to an existing subscription, which remains governed by the version in force at the time of payment.

18. Governing law

These terms are governed by the laws of the Kingdom of Bahrain, and the courts of Manama have jurisdiction over any dispute, without prejudice to any mandatory rights granted by consumer protection law in the athlete’s country of residence.

Declaration

By completing payment, the athlete confirms they have read, understood and accepted these terms, that they meet the eligibility conditions in clause 3, and that the information they provide will be accurate and complete.
